Experienced Counsel Educating Clients Seeking Child Custody

Courts in Connecticut no longer use the terms child custody and child visitation. While many people and lawyers still use these terms, the courts use terms like parent access and parenting plans to address the time children spend with either parent following divorce or separation. I will work closely with you so that you understand the law and how it applies to your situation and can make intelligent, informed decisions regarding the custody of your children and the future of your family. I can help you with any of the following matters:

  • Child custody and visitation/parent access — Determining child custody is one of the most difficult and contentious issues in divorce. I offer experienced and honest guidance with establishing child custody and parenting plans that address physical and legal custody, including establishing parenting schedules, identifying how health insurance will be paid for the child and how important decisions affecting the child’s upbringing will be made by the parents. I can represent your interests throughout the process, from initial custody proceedings while a divorce or custody case is pending (temporary custody) through permanent custody proceedings.
  • Child custody modifications — It is important to realize that changes in circumstances — due to a parent relocation request or simply because the child’s needs have changed as he or she has grown older — may necessitate a modification of custody and parent access plans. I can assist with these matters for either parent. I am experienced in filing motions for enforcement orders as well if one parent fails to abide by an outstanding custodial order.
  • Paternity — When your child is born outside of marriage, a paternity action can establish the legal father-child relationship and an appropriate amount of child support. A man who does not believe he is a child’s father has the right to dispute paternity and request a DNA genetic parentage test. Whether you are seeking to establish or contest paternity, I can protect your interests through this process.
  • Mediation and collaboration — In most situations, custody litigation is much harsher on children than it needs to be. Other methods of resolution better take the emotional needs of your children into consideration. Often, custody determinations — even if initially contested — can be resolved amicably, respectfully and in the best interests of the children through mediation  processes or a collaborative process. If you and your spouse are able to proceed cooperatively or are open to exploring one of these methods of alternative dispute resolution (ADR), you may save time, money and emotional expense. This approach leaves the important decisions up to the parties instead of a judge who is not familiar with your situation. I am trained in these alternative dispute methods and can inform you if they are right for your situation. (View my page on avoiding divorce litigation.)
